I always wondered if this whole tragedy would result in a criminal investigation. Given certain facts we know and that even ASU's report admitted, there is clearly some person or persons who is at least partially at fault due to some kind of negligence.
We at least know the following occured:
ASU policy is to have ice baths and other emergency safety measures in place in case of this exact thing happening. This policy was NOT followed and the safety measures were NOT present.
All workouts run by a non-ASU employee have to be submitted for review to the AD office and go through some type of vetting and approval process by the AD office. This process was circumnavigated by somebody who submitted that Zeiss was only coming to "speak to the team". The AD was never made aware nor asked for permission for him to run a workout for the team. HE was framed as bascially a motivational speaker to the AD office and not as a workout instructor.
Not following safety protocols AND misrepresenting what Zeiss was there for creates some kind of legal jeopardy I am sure. Not like "murder" or "voluntary manslaughter" levels of bad here, but it seems like if Matthew passes from this that "involuntary manslaughter" might be on the table for someone, especially if its found that the person who brought in Zeiss, submitted the "motivational speaker" request to the AD, and did not make sure the safety measures were in place are all the same person. In his crappy press conference yesterday Powers seemed to be deflecting the blame off him and onto the strength and conditioning coach. So even though we all agree that ultimately the buck stops at Powers, all the negligent activities that resulted in this tragedy actually could have been done by the S&C coach or staff member. There is a real possibility that Powers talked to the S&C about toughening up the team this year because last year was too soft, and this entire workout was then the brainchild of the the S&C coach, who scheduled Zeiss, and submitted the paperwork to the AD, and did not follow the safety protocols. The law would find that individual at fault, not necessarily Powers.
