The main issue is state-law preemption — essentially, what states would still be allowed to regulate after the federal Protect College Sports Act becomes law.
The Baldwin/Kaine amendment would:
Prevent states from enforcing laws that conflict with the federal bill.
Prevent states from regulating or invalidating institutional/conference/NCAA rules concerning:
NIL compensation
Transfers
Certain athlete eligibility provisions.
At the same time, it specifically preserves a substantial list of state laws and legal remedies, including:
Civil-rights laws
Tort law
Criminal law
Privacy/data-breach laws
Contract law
Trademark and copyright law
Consumer-protection laws
Personal-injury and wrongful-death claims
Sexual-assault and harassment claims
Fraud
Abuse/Hazing
Campus/Student-Safety claims.
