They are not going to make themselves look like fools and get sideways with the judge once they promised her they'd reached a settlement agreement. We're not dealing with fly-by-night legal firms. They also have reputations to uphold.
Duh. Of course, Thayer wasn't in the room. But he has been spot-on throughout the legal proceedings, starting on Day 1 in Colfax.

Settlements are delayed and get fouled up all the time. I had cases, where I had settlements on paper, & they were still going on 2+ years later.
There was something that we hadn't considered or they hadn't considered. The person signing off on it died or quit or was fired. We realized at the last second that we needed a signoff that we were just never going to get. A document that we absolutely needed got lost in the mail & the only person in the entire world that could fix it decided to move to a nondescript lot in the middle of the Arizona desert. We need a different judge in a different case to sign off on the whole thing. There is a new case that we just became aware of that is 100% on point and makes the other side's case moot. There is a bankruptcy stay that we were not considering that controls. We disagree about one term in a 15-page settlement agreement. We need multiple parties one side to 100% agree to something & 1 changed their mind, or we misunderstood them, or they're bankrupt, or the only person in the entire world that can sign off on something has moved to Asia or England or Italy or Mexico or Spain. Etc.
If I had a nickel every time that I thought that I had a settlement & it fell apart in the 11th hour, I would have a trunk full of nickels. The judges hate it, but you do what's in your client's best interest, judges be damned.
