IMO you raise some great points, but there were multiple legal holes left in the Alston decision that part of this bill is exploiting. The Supreme Court refused to rule that college football players are actually employees. This prevents any sort of unionization, and to be honest this current court would never support this based on previous rulings.
The Supreme Court also refused to say if NIL or Pay-for-play was legal/illegal. This is where the real bread and butter is because there was a line in the ruling that stated they couldn’t determine legality because this should be controlled by congressional action, not a ruling from the highest court.
The bill also doesn’t limit the pay players are receiving. It’s limiting the schools, collectives and boosters from paying out an unlimited amount of money. Players are still able to profit off brand deals, autograph signings, appearances etc. Players can make all the cash they want, just not from schools or boosters.
There will 100% be challenges to this bill, and of course anything can happen, but the general consensus is the Supreme Court will not rule against this bill due to what the next steps would be which is a players union, and controlled pay via a CBA. This current Supreme Court has also limited what CBA language companies are legally bound to. Unions are being gutted on a yearly basis and there’s absolutely zero chance this court changes that.
All in all the Alston ruling was really vague in the grand scheme of things. It only really addressed the NCAA rules on paying players at the time. It never said pay couldn’t be controlled. Either way, no matter what happens, when everything is done there will be limits just like in the NFL and other sports leagues. Every NFL player is limited to what they can make in the first 3 years on their rookie contracts. The same thing would happen here.
